1. Acceptance of Terms

By accessing or using any of our hosting or game-server panel services, you agree to comply with and be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our services.

2. Service Description

2.1 Website Hosting
• Provision of server space, bandwidth, DNS, and e-mail forwarding as per your chosen plan.
• 24/7 infrastructure monitoring, basic technical support, and daily backups (retained for 7 days).

2.2 Game-Server Panel Hosting
• Tailored Arma Reforger server hosting via our custom-branded Pterodactyl panel (“Sammys Servers Panel”).
• Start/stop/restart controls, mod management, scenario selection, automated backups, and standard security hardening.

2.3 Uptime & Maintenance
• We guarantee 99.95% monthly availability, excluding scheduled or emergency maintenance and outages caused by your own configurations.
• Up to 2 hours/month scheduled maintenance (24 hours’ notice).

3. User Responsibilities

• Content & Conduct: You are solely responsible for all content you upload (websites, files, mods), and must comply with all laws. Prohibited activities include distributing malware, phishing, DDoS, copyright infringement, or any unlawful use.
• Security & Backups: Maintain the security of your account credentials and regularly back up your own data—daily backups we provide expire after 7 days.
• Mod Usage: Although we provide mod-management tools, we do not develop or sell mods. We can help identify unstable third-party mods but cannot fix or customize them. Installing many mods increases the risk of crashes.

4. Fees, Billing & Payment

• All fees are stated in GBP (or USD if specified) plus any applicable taxes.
• Payment methods: PayPal and Stripe.
• Billing cycle: Due in advance on the first day of each term (monthly, quarterly, annual). Subscriptions auto-renew unless canceled before renewal.
• Late payments incur 1.5% interest per month (or the maximum legal rate) plus collection costs.

5. 3-Day Money-Back Guarantee & Refund Policy

• Full refund of setup fees and first term fees if requested within three (3) days of your invoice date. Email help@sammys.app to claim.
• After 3 days, refunds are at our sole discretion and may be prorated based on unused term and administrative costs.
• No refunds on subsequent renewal payments.

6. Termination & Suspension

• By You: Cancel anytime via the control panel or email; services remain active until the end of your paid term (no prorated refunds except within the 3-day window).
• By Us: We may suspend or terminate immediately for non-payment, material breach, illegal activity, or misuse of services. Termination for cause forfeits any remaining term credits.
• On termination, your panel access and backups are revoked; data is retained for 7 days then deleted.

7. Service Credits for Downtime

If monthly uptime falls below 99.95%, submit a claim within five (5) business days after month-end to help@sammys.app. Credits apply to the next invoice as follows:
• 99.50–99.95% ⇒ 5% credit
• 99.00–99.50% ⇒ 10% credit
• < 99.00% ⇒ 25% credit

8. Limitation of Liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, consequential, or punitive damages. Our total aggregate liability is capped at the fees you paid in the six (6) months preceding any claim, except for valid service-credit claims.

9. Intellectual Property

• All software, trademarks, panel assets, scripts, and proprietary tools remain our exclusive property (or that of our licensors).
• You retain all rights to your uploaded content; by uploading you warrant you hold all necessary rights and licenses.

10. Confidentiality

Both parties will keep confidential any non-public business or technical information disclosed in connection with these services, using at least reasonable care and only for performing obligations under these Terms.

11. Force Majeure

Neither party is liable for failure or delay caused by events beyond reasonable control (e.g., natural disasters, acts of war, strikes, governmental action, third-party outages). Affected obligations are suspended until the event is remedied.

12. Changes to Terms

We may update these Terms at any time by posting a revised version at sammys.app/terms. Continued use of services after posting constitutes acceptance of the new Terms. We’ll make reasonable efforts to notify you of significant changes via email or a banner.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of England & Wales. Any dispute that cannot be resolved informally within 30 days may be brought exclusively in the courts of England & Wales.
